1. Validity of the Terms and Conditions of Sale
1.1. The Terms of Sale holyeli.eu apply to the purchase of goods and services between the buyer from the online store (hereinafter referred to as the Consumer) and the entrepreneur Else Click OÜ (hereinafter referred to as the Online Store holyeli.eu).
1.2. The owner of the online store is Else Click OÜ (registry code 16670406, located at Meriski 6 – 9, 12916 Tallinn; phone +372 59005003; e-mail info@holyeli.eu), whose online store is located on website holyeli.eu (hereinafter the online store).
1.3. The legal relationships arising from the purchase of products from holyeli.ee online store are regulated by the Law of Obligations Act (hereinafter the Law of Obligations Act), the Consumer Protection Act (hereinafter the Law of Obligations Act) and other legal acts in force in the Republic of Estonia.
1.4. The online store holyeli.eu reserves the right to make changes to the terms and conditions of sale. These changes will be reflected on the website holyeli.eu.
2. Price information
2.1 All prices holyeli.eu in the online store are in euros and include VAT.
2.2. The price of transport is not added to the price of purchases if the delivery is within Estonia. Delivery is free. The price of transport will be added to the price of the purchases according to the delivery method chosen by the Consumer, if the delivery is within Latvia and Lithuania.
2.3. The prices are valid from the time the order is placed until the expiry of the payment term of the order (1 day after the order has been placed).
2.4. If the order has been placed before the terms of sale or prices have been changed, the terms and conditions in force at the time of placing the order shall be applied to the legal relations between the Consumer and holyeli.eu.
2.5. The online store holyeli.eu reserves the right to make changes to the sales prices. These changes will be reflected on the website holyeli.eu.
3. Placing an order
3.1. Add the desired products to the shopping cart.
3.2. To see the contents of the shopping cart, select “Shopping Cart” in the upper right corner of the website.
3.3. To place an order, first click on the “Pay” link in the shopping cart.
3.4. Next, choose whether you want to place the order as a one-time or loyal customer (if the online store has such a division).
3.5. On the order page, fill in the required data fields, select the delivery method and payment method suitable for you and click on the link “Submit Order”. An invoice will then be displayed on the screen, which can be paid via a bank link. After the invoice has been paid, the order confirmation will be sent to the e-mail address you have provided.
3.6. Please fill in the fields on the data and order confirmation page carefully, because the accuracy and correctness of the information provided will determine the fast and smooth delivery of the products you have purchased and the subsequent resolution of disputes and complaints.
3.7. Orders placed in the online store are processed on working days (Mon−Fri 10.00−17.00). If the order is placed on Friday after 17:00, the order will be placed on the following Monday, unless otherwise agreed.
3.8. In the online store holyeli.eu, the rule “I will pick up the goods myself” does not apply.
4. Entry into force of the sales contract
4.1. With the contract of sale of the goods, the online store undertakes to holyeli.eu to hand over to the Consumer the Goods that exist, are being manufactured or acquired by the online store holyeli.eu in the future and to make the transfer of ownership possible to the Consumer, while the Consumer undertakes to pay the amount indicated on the invoice submitted for the Goods to the online store holyeli.eu and to accept the Goods.
4.2. Orders that have not been paid for will be cancelled after 3 calendar days from the placing of the order.
4.3. The sales contract enters into force after the payment made by the Consumer has been received on the bank account of Else Click OÜ.
5. Delivery
5.1. If the product is marked with the label “Available immediately”, then after the sales contract enters into force, the online store will assemble holyeli.eu order within 1-2 working days and hand it over to the company’s logistics partners for delivery. Thereafter, the logistics partner will deliver the product to the Consumer within 1-3 working days, except in the event of force majeure or other circumstances that the logistics partner could not foresee or prevent.
5.2. If the goods are not immediately available and need to be ordered, the delivery time is up to 15 working days.
5.3. The exact delivery time is indicated next to each product.
5.4. The delivery deadlines indicated on the website of the online store apply to the logistics partner from the moment the order is handed over.
5.5. The logistics partners of Else Click OÜ are AS Eesti Post (Omniva).
5.6. The goods will be sent to the Omniva parcel machine specified in the order to the consumer.
5.7. To ensure delivery without delay, you must be diligent and submit true and valid data when placing an order.
5.8. The online store holyeli.eu is not responsible for the delay in the delivery of the goods if the goods have been handed over to the logistics partners on time, but the delay in delivery is due to circumstances that the online store could holyeli.eu influence or foresee.
5.9. If it is not possible to deliver the ordered goods due to the unexpected end of the goods, the Online Store will notify the Consumer thereof and refund the money paid to the Consumer (including the costs of delivering the goods) immediately, but no later than after 14 days.
5.10. If an existing product and an ordered product are purchased at the same time, then the immediately available product will also be issued after the ordered product arrives at the warehouse, unless otherwise agreed with the Buyer.
5.11. In exceptional cases, the goods have the right to be delivered within up to 45 calendar days.
6. Right of return
6.1. After receiving the order, the Consumer has the right to withdraw from the contract concluded in the e-shop within 14 days without giving a reason. The 14-day right of withdrawal does not apply if the consumer has opened an item handed over in a sealed package that is not suitable for return for health protection or hygienic reasons, or if the products or services are not returnable within the meaning of subsection 53 (4) of the Law of Obligations Act (e.g. underwear, bras, swimwear and sunbathing clothes, stockings and socks, cosmetics with open packaging, perfumes and hygiene products, blankets and pillows).
6.2. In the event of deterioration of the item to be returned, the consumer shall be liable for the decrease in value caused by the use of the item only if he or she has used the item in a manner other than is necessary to ascertain the nature, characteristics and functioning of the item. In order to ascertain the nature, properties and functioning of the item, the Consumer should handle and use the item only as he or she would normally be allowed to do so in a store. For example, it is possible to try on clothes in the store, but the labels must not be removed from the clothes, the clothes must not be dirty, damaged or spoiled by perfume, smoke or any other off-smell. Therefore, it cannot be ruled out that the value of the product has decreased to zero due to damage to the item and Else Click OÜ has the right to ask for compensation for the decrease in the value of the item. The transport costs of deteriorated goods are covered by the Consumer.
6.3. If the product has been purchased as part of a campaign, where another product has been added to the product (e.g. a gift), the Consumer must return the entire set (i.e. all products).
6.4. In order to return the goods, you must submit a free-form application for withdrawal from the purchase of the goods and send it to the e-mail address info@holyeli.eu within 14 days of receipt of the goods at the latest, or submit an application for withdrawal from the purchase of the goods, the form of which can be found in the online store holyeli.eu here.
6.5. The consumer must return the goods within 14 days of submitting the request or present a certificate that they have handed over the goods to a logistics company within the aforementioned period. The costs related to the return shall be borne by the Consumer.
6.6. Upon receipt of the withdrawal application, Else Click OÜ shall refund to the Consumer immediately, but no later than 14 days after receipt of the withdrawal application, all fees received from the Consumer on the basis of the contract. Else Clikc OÜ has the right to delay the refund until the Consumer has returned the product or presented a certificate that the Consumer has returned the product.
6.7. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the Consumer if the price of the goods in the Online Store is significantly lower than the market price of the goods due to a mistake or technical reason.
6.8. All costs of withdrawing directly from the goods shall be borne by the Consumer, except in the case of clause 6.7.
6.9. The right of withdrawal does not apply if the buyer is a legal person.
7. Force majeure
7.1. The online store holyeli.eu shall not be liable for any damage caused to the Client or the delay in the delivery of the goods in the event that the damage or delay in the delivery of the goods is caused by circumstances that the online store could holyeli.eu influence or foresee.
7.2. The online store holyeli.eu is not responsible for any color difference caused by the screen settings.
8. Processing of personal data
8.1. By entering data in the online store and with the relevant confirmation, the Consumer gives the right to collect and process the Consumer’s personal data (name, contact phone number, parcel delivery and/or home address, e-mail address) and to forward personal data to the logistics partner for the delivery of the goods.
8.2. The online store holyeli.eu has the right to use the address of the Consumer’s residence or location for forwarding advertising and other information to the Consumer.
8.3. The consumer has the right to prohibit the collection and use of his or her personal data at any time, except if it is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
8.4. The use of electronic personal data for direct mailing takes place only if the Consumer has given separate consent for it on the website holyeli.eu.
8.5. The online store holyeli.eu sends newsletters and offers to the Consumer to the Consumer’s e-mail address only if the Consumer has expressed a wish to do so by entering the e-mail address on the website and has notified the Consumer of his/her wish to receive direct mail notifications.
8.6. Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal bank identifiers and the Online Store does not have access to them.
9. Intellectual property and its use
9.1. All intellectual property on holyeli.eu website, Facebook and Instagram pages is the property of Else Click OÜ and is protected by copyright law.
9.2. Copying, distributing, publishing for commercial purposes, using in mass media or otherwise using intellectual property without the author’s consent is prohibited.
10. Procedure for submitting complaints
10.1. The online store holyeli.eu shall be liable for the non-compliance of the goods sold to the Consumer with the terms and conditions of the contract or for defects that become apparent within up to two years from the delivery of the goods to the Consumer.
10.2. In the event of a defect, the consumer has the right to contact the holyleli.eu within two months at the latest, submitting an invoice on the basis of which the purchase of the goods was paid. Notice of non-conformity of goods must be sent to holyeli.eu e-mail address info@holyeli.eu or by calling +372 59005003. If the Consumer fails to notify of the non-conformity of the goods within the term set out in this clause, the holyeli.eu shall be released from liability for the non-conformity of the goods.
10.3. If there is a defect in the goods, please stop using the goods.
10.4. The repair or replacement of defective goods is agreed between the online store holyeli.eu and the Consumer. The costs of repairs are covered by the online store holyeli.eu.
10.5. The online store holyeli.eu shall not be liable for any defects in the product that have arisen as a result of improper storage or improper use of the product.
10.6. In case of non-compliance or defects in the product, please send a complaint to the e-mail address info@holyeli.eu , indicating the name of the person placing the order, contact phone number, order number and a detailed description of the product’s non-compliance or defect.
10.7. A complaint about the discovery of a product’s non-compliance or defects must be submitted within two months of discovering the product’s non-compliance or defect.
10.8. All complaints will be reviewed and the Consumer will be contacted as soon as possible, but no later than within 14 days of receipt of the complaint.
10.9. The consumer has the right to demand from the online store a reduction of the purchase price of the holyeli.eu or the termination of the contract and to demand a refund for the goods if the online store is holyeli.eu unable to repair or replace the goods, the repair or replacement of the goods fails, the online store holyeli.eu has not eliminated the defect in the goods within a reasonable time, and the consumer has been caused unreasonable inconvenience. In addition, in the event of non-compliance of the item with the terms of the contract, the Consumer has the right to refuse to perform the obligation owed, demand compensation for damages, and in the event of delay in the performance of a financial obligation by Else Click OÜ, demand interest on arrears.
11. Consumer’s right to turn to the Consumer Complaints Committee
11.1. If the Online Store has refused to resolve the Consumer’s complaint or the Consumer does not agree with holyeli.eu proposed solution and finds that their rights have been violated or their interests have been damaged, the Consumer may submit a complaint to the Consumer Complaints Committee through the Consumer Protection Board or to the court. The consumer may lodge a complaint on his or her own or through a representative. The data of the Consumer Protection Committee are available on the website of the Consumer Protection Board, in order to solve problems arising in the Member States of the European Union, contact the European Consumer Centre.
